These Terms of Service ("Terms") explain what to expect from us and what we expect from you. By accessing or using Probe's platform, including our mobile application, website, and Instagram integrations (collectively, the "Service"), you agree to be bound by these Terms. Use Probe responsibly.

Probe Network Inc. ("Probe," "we," or "us") reserves the right to update these Terms at any time. Continued use of the Service constitutes your acceptance of such updates.

1. Agreement to Terms

By accessing or using the Service, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, you must not use the Service.

2. Eligibility

You must meet the minimum age requirement to enter nightclubs in your jurisdiction and be at least 18 years old to use the Service. We reserve the right to verify your age and identity and may suspend or terminate accounts that fail to meet this eligibility criterion.

3. Account Registration and Security

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to provide accurate, complete, and updated information and to maintain the confidentiality of your credentials. You are responsible for all activity on your account.

3.2 Account Responsibility

You agree not to share your account credentials with others or create multiple accounts. Any misuse may result in suspension or termination.

3.3 Instagram Account Connection

When you connect your Instagram Business or Creator account to Probe:

• You authorize Probe to access your Instagram account per the permissions you grant
• You are responsible for maintaining your Instagram account credentials
• You must ensure your Instagram account complies with Meta's terms
• You can disconnect your Instagram account at any time through Probe settings

When using Instagram integrations, you agree to:

• Use features in compliance with Meta's Platform Terms and Instagram policies
• Not use automated messaging for spam or harassment
• Create appropriate, professional trigger messages
• Monitor AI agent responses for accuracy and appropriateness
• Not attempt to circumvent rate limits or other restrictions
• Respond to user complaints about automated messages
• Comply with all applicable laws regarding automated messaging

5.1 Prohibited Conduct

You agree not to engage in:

• Harassment, abuse, or harm of other users
• Sharing of objectionable, hateful, or illegal content
• Misrepresentation of events, venues, or your identity
• Manipulation of Service features, such as the "Fire Rating" system
• Unauthorized commercial activity or promotions
• Using Instagram features for spam or unsolicited messaging
• Violating Meta's Platform Terms or Instagram Community Guidelines
• Attempting to bypass rate limits or automation restrictions

5.2 Content Standards

All user-generated content, including Instagram trigger messages, must:

• Be truthful and respectful of others' rights
• Comply with all applicable laws and regulations
• Avoid promoting illegal activity, hate speech, or discrimination
• Comply with Instagram Community Guidelines when sent via Instagram
• Be transactional (not promotional) when automated

6. Safety and Abuse Prevention

6.1 No Tolerance for Objectionable Content

We maintain a strict no-tolerance policy for objectionable content or abusive behavior. Violation of this policy may result in immediate suspension or termination of your account.

6.2 Flagging and Reporting

The Service provides tools for users to flag objectionable content or report abusive behavior. Reports can be made anonymously, and we will act on all valid reports within 24 hours.

6.3 Blocking Abusive Users

You can block users directly through the Service to prevent further communication. For Instagram DMs, users can also block your business account through Instagram settings.

7. Membership and Payment Terms

7.1 Membership Plans

Details about membership fees and terms will be disclosed at the point of purchase. By subscribing, you agree to recurring payments until cancellation.

7.2 Refunds and Cancellations

You may cancel your membership anytime. Refunds are subject to applicable laws and Probe's refund policy.

8. Privacy and Data Usage

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your information, including Instagram data. By using the Service, you consent to these practices.

9. Instagram Integration - Specific Terms

9.1 Meta Platform Compliance

Our Instagram integration is built on Meta's official Instagram Graph API and is subject to:

By using Instagram features, you agree to comply with all Meta policies in addition to these Terms.

The AI agent is an automated system and may not always provide perfect responses. You acknowledge that:

• AI responses are generated automatically and may contain errors
• The AI agent is designed for guestlist management, not general conversation
• You should monitor AI agent interactions and intervene when necessary
• Probe is not liable for miscommunications or errors in AI responses
• Users can always contact you directly outside of the AI agent

9.5 Comment Trigger Responsibilities

When creating comment triggers, you are responsible for:

• Creating appropriate, professional trigger messages
• Ensuring messages comply with Instagram Community Guidelines
• Choosing keywords that are relevant and not misleading
• Monitoring trigger activations and adjusting if issues arise
• Responding to users who have concerns about automated replies

9.6 Instagram Service Interruptions

Instagram features may be temporarily unavailable due to Meta API changes, rate limiting, token expiration, or technical issues. Probe is not liable for service interruptions caused by Meta's platform or Instagram's systems.

10. Intellectual Property

10.1 Ownership

All content, features, and functionality of the Service (including AI agent technology) are owned by Probe and protected by intellectual property laws.

10.2 User Content

You retain ownership of content you post but grant Probe a worldwide, non-exclusive license to use it for Service-related purposes, including:

• Displaying your event information to other users
• Processing Instagram messages with our AI agent
• Storing trigger messages and sending them via Instagram
• Analyzing data to improve service quality

11. Third-Party Services and Integrations

The Service integrates with third-party platforms and services:

12.1 No Warranties

The Service is provided "as is" without any warranties, express or implied. This includes, but is not limited to:

• Accuracy of AI agent responses
• Reliability of Instagram integrations
• Availability of automated features
• Delivery of Instagram messages

12.2 Limitation of Liability

Probe is not liable for indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to:

• Miscommunications via AI agent
• Failed message deliveries via Instagram
• Loss of data due to Instagram API changes
• Suspension of Instagram features by Meta
• Rate limiting or temporary service unavailability

12.3 Instagram-Specific Disclaimers

13. Termination of Use

13.1 By You

You may terminate your account at any time through the app settings. When you terminate:

• Your account will be deactivated
• Instagram connections will be disconnected
• Access tokens will be deleted immediately
• Data retention follows our Privacy Policy (90 days for messages)

13.2 By Probe

We reserve the right to suspend or terminate accounts for:

• Violation of these Terms
• Violation of Meta's Platform Terms or Instagram policies
• Abuse of Instagram features (spam, harassment, rate limit violations)
• Fraudulent activity or illegal use
• Any other reason at our discretion

14. Changes to Terms

We may update these Terms periodically. Material changes will be communicated via the Service or email. Continued use of the Service constitutes acceptance of the updated Terms.

For Instagram features, we may need to update terms quickly to comply with Meta policy changes. We will notify you of such changes and may require re-consent to continue using Instagram features.

15. Dispute Resolution and Governing Law

These Terms are governed by the laws of the jurisdiction where Probe Network Inc. is registered. Any disputes shall be resolved through binding arbitration unless otherwise required by law.

For disputes related to Instagram features, Meta's terms and dispute resolution procedures may also apply.

16. Indemnification

You agree to indemnify and hold Probe harmless from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of Meta's Platform Terms or Instagram policies
• Content you create or send through Instagram features
• Your use of AI agent or comment trigger features
• Any harm caused by messages sent through your Instagram account

17. Severability

If any part of these Terms is deemed invalid, the remainder shall remain in full force and effect.
